If something is FDA approved, can it be illegal in the states ie: marijuana?
I’m just wondering, let’s say the food and drug administration does approve marijuana, can it still be illegal in states?
What will come first in your opinion, state legalization or FDA approval? What if more states start to legalize it medicinally will it become an actual prescription rather than a recommendation?
Finally, do you believe the war on drugs is no longer divided among Democrats/Rupublicans?
Something that is FDA approved can be illegal in some states.
Illinois, New York, and California banned the retail sale of things that contained ephedra or ephedrine alkaloids while they were approved by the FDA. Of course the FDA later banned it. (see ref 2 below).
It could be a minefield where cannabis is concerned.
The FDA is responsible for legislation that controls substances as far as interstate commerce is concerned. It’s illegal to import, export and move cannabis across state lines without prior authority, but use of it is not banned outright: it’s controlled. Things containing THC are approved but controlled.
Marinol, which contains synthetic THC (and more per dose than a joint), is approved by FDA and approved by every state.
FDA has cannabis as a controlled substance, but a state might control it by banning it or restricting it to be grown for personal use or for use by a limited number of “customers” for a specific purpose within that state.
That is what is happening at present. Some states ban it outright, some allow it.
Strangely, though, FDA has exempted cannabis from control where it’s used for animal feed – even if it contains THC.
In the states where it’s medicinally legal it must be legal to prescribe cannabis, but it cannot be sold in an open market to anyone who wants to buy it.
I’m not sure what you mean by the “war on drugs” being divided.
There is some movement towards cannabis being “decriminalized” on a national level, where it’s already well on the way to decriminalization at a state level. Some politicians believe that it should not be. In that way it is divided.
You might be allowed by local and state police to use cannabis, but federal law enforcement would arrest you. That situation’s crying out to be remedied. I don’t know what would happen if members of one party seek to re-criminalize it.
